1 INTRODUCTION

1.1 These Terms and Conditions regulate the sale, including the registration, of SilVin’s products through the website https://silvin.pt

1.2 The website https://silvin.pt is managed by Silvin Comércio de vinhos Lda, nipc 506222748, Rua Guilherme Gomes Fernandes, 4400-290, Vila Nova de Gaia, Portugal.

1.3 For the purposes of these Terms and Conditions, the following terms and conditions shall apply: a) – “SILVIN” – The products sold on the website https://silvin.pt
b) – “User” – Any natural person, not a trader, who places an order through the website https://silvin.pt

1.4 The use of the https://silvin.pt website and the purchase of products implies knowledge, understanding and acceptance of these Terms and Conditions by the User.

2. WEBSITE REGISTRATION

2.1 To place an order, the User can previously register by filling in the form existing in the website https://silvin.pt. It is also possible to place an order without prior registration.

2.2 From the moment of accessing their personal account, the User is subject to these Terms and Conditions.

3. THE SILVIN PRODUCTS

3.1 The website https://silvin.pt is aimed at all users, of legal drinking age, who wish to purchase products from their home or workplace, 24 hours a day, 7 days a week.

3.2 SILVIN reserves the right to modify, at any time, the information, product offer, prices, promotions and commercial conditions presented on the website https://silvin.pt.

4. ORDERING FROM THE WEBSITE

4.1 To order from https://silvin.pt, the user must be of legal drinking age, have an e-mail account and have their browser configured to accept cookies and pop-ups, which will allow them to use all the navigation conditions of the online SILVIN shop.

4.1.1 The User may purchase products online, for which purpose it is necessary to: a) Find the product(s) they wish to purchase; b) Add the selected product(s) to the “Shopping Basket
c) Register the User’s personal data, which will be integrated in SILVIN’s database in accordance with the Privacy Policy, including the “Delivery Address”, “Billing Address”, “Payment Method”, telephone number and tax identification number (NIF);
d) Review your order and confirm the order;

4.2 You will receive an order confirmation email with the details of the payment method you have selected.

4.3 Your order will be delivered by the logistic operator to the delivery address indicated in the purchasing process and with the respective detailed invoice.

4.4 By sending the order form, the User accepts the Terms and Conditions of purchase described at https://silvin.pt, as well as the Privacy Policy.

4.5 SILVIN reserves the right not to accept and to cancel orders already confirmed in the following situations:

a) The product is not available;

b) Payment is not made using any of the payment options available on the website https://silvin.pt.

c) The payment is not confirmed;

d) The invoicing information is not correct or verifiable;

e) There is an error in the price quotation;

f) It is not possible to deliver to the address provided by the User.

5. PRICES

5.1 The prices of the products displayed on the https://silvin.pt website include Value Added Tax (VAT). The total VAT payable by the User will be indicated on the invoice to be sent to the User.

5.2 All prices are quoted in euros (€). Please note that changing the country of delivery can have an influence on prices due to different transport costs. Customs costs relating to the country of delivery of the order will be borne by you.

5.3 The prices of the products shown on the website are subject to change. SILVIN reserves the right to change prices without notice. The prices displayed at the time of purchase are the prices applied to that purchase.

5.4 If there is an error in the price of the products ordered, either SILVIN or the user may cancel the order until the order is dispatched.

5.5 The total price specified at the end of the order includes tax for the destination country if this is an EU country (27 countries) or for the country of departure (Portugal) if this is outside the EU and delivery costs.

5.6 You should only pay the amount specified in the order confirmation.

6. PAYMENT METHODS.

6.1 You may pay for your purchases using IfThenPay, debit card, MBWay (Portugal only) or bank transfer.

6.2 SILVIN does not accept any other payment method other than those mentioned in the previous point. You should not attempt to pay by any means other than the payment methods specified. If you do so, we cannot be held responsible for loss of payment or any other damages that may result.

7. SHIPPING COSTS

7.1 You can find the shipping costs on the link on our “Shipping” home page.

8. DELIVERY

8.1 SILVIN will send the product(s) ordered by the User from Monday to Friday, from 10am to 7pm, excluding public holidays, on the days and times used by the logistics company, to the delivery address indicated by the User.

8.2 The delivery service does not include the option of scheduling in advance, so that the delivery of the order will be made by contact from the carrier on the day of delivery (via SMS or phone call), and it is necessary to ensure that someone is at the destination address. If delivery is not possible, a pick-up note will be left in the mailbox or a message will be sent to your mobile phone so that you can pick up your order at a collection point near your destination address.

8.3 Delivery times vary depending on the destination country. You can check this estimate on the link on the “Shipping” homepage.

8.4 Upon delivery, You should inspect the packaging to check for any damage. If the products are damaged, the User should not accept the delivery of the order which will be returned. The user should report the situation, with photographs if possible, through our e-mail address. If the user agrees, SILVIN will resend the order at no cost to the user. If the User wishes to cancel the order, the total amount paid will be refunded.

8.5 If you do not receive your order within a maximum period of 90 (ninety) days from the date of payment of your order, please send us an e-mail informing us of this fact. After this period, SILVIN will not be responsible for any lost order.

8.6 Delivery is considered to have taken place upon signature of the delivery receipt at the agreed address.

9. RIGHT OF FREE TERMINATION

9.1 The User may rescind its contract up to 14 (fourteen) days after receiving the order, provided that

(a) the product(s) have not been used;

b) The product(s) maintain their original characteristics and labels intact;

c) The product(s) are complete. All material accompanying the orders must be returned.

9.2 The User can exercise its right of free resolution by sending us the Free Resolution model or by any other unequivocal declaration of contract resolution to our e-mail address.

9.3 The costs of returning the order when exercising the right of free resolution are borne by You.

9.4 Once we receive the returned product, SILVIN will analyse and confirm the condition of the order and, where applicable, will reimburse within a maximum period of 15 (fifteen) days the amounts paid by the User in the order, through the same means used to pay for the order.

9.5 If the returned articles show signs of having been used, SILVIN reserves the right to refuse to accept the return and to refuse reimbursement.

9.6 The User should note that if the return is made for reasons other than the justified existence of a defect or non-compliance of the ordered products, SILVIN will not reimburse the shipping costs. Therefore, SILVIN will not reimburse the costs of postage initially borne by the customer for the respective order.

10. CANCELLATIONS AND RETURNS

10.1 You may cancel your order as long as you request this via our e-mail address prior to its dispatch.

10.2 If the order has been received before shipment, we will refund the amounts paid by the User in the order, through the same means used for payment of the order, within a maximum period of 15 (fifteen) days.

10.3 If the order is received after shipping, the rules set out in the previous section on the right of free withdrawal will apply.

10.4 SILVIN does not offer direct exchanges. The User may opt for a voucher to exchange his or her order for another article available on the website, at his or her own expense for the new shipment. Please note that orders made with a voucher and subsequently returned will only be able to receive a new voucher as a refund.

10.5 Should the ordered product be found to be defective or otherwise non-compliant, the User may choose to
a) replacing the product;
b) terminate the contract.

10.6 As soon as the User notices a defect or other non-conformity of the product, the User should inform us via email, sending confirming photographs.

10.7 As soon as we receive your email, we will contact you to solve the problem in a consensual way.

10.8 In any of the options exercised by you under 10.6, the respective costs will always be borne by EPW.

11. QUALITY

SILVIN does not sell second hand products, defective or inferior quality to the standards existing in the market.

The main characteristics of each product shown on https://silvin.pt can be found on each product page.

SILVIN makes every effort to ensure that the colours of the products shown on the https://silvin.pt website are as accurate and real as possible.

However, as computer monitors and other electronic products vary, we cannot guarantee that your monitor is showing accurate colours.

The years shown on photographs of bottles sold on https://silvin.pt may occasionally not correspond to the vintage year of the bottle being sold at the time of purchase. The same may apply to the labels, (at the level of graphics, colours, cuts, letters or logos).

12. COMPLAINTS

With a view to the continuous improvement of the services provided, SILVIN will endeavour to attend to and resolve any complaints made by the User within 5 (five) working days, via our e-mail address

13. WARRANTY AND AFTER SALES SERVICES

SILVIN products benefit from the conformity guarantee provided by the legislation applicable to the sale of consumer goods.

14. EXCLUSION AND LIMITATION OF LIABILITY

SILVIN does not guarantee the uninterrupted functioning of the website https://silvin.pt, or any of its functionalities, and may suspend it for maintenance, repair or updating.

Similarly, SILVIN will not be liable for any damages arising directly or indirectly from situations of force majeure that prevent SILVIN from fulfilling its obligations in any way, in particular strikes, failures in the electricity grid, telecommunications services or any other services, fires, floods, impossibility of obtaining products, materials or services, breakdowns, delays by suppliers or carriers, and changes in legislation or administrative regulations.

SILVIN is not liable for any misuse of the user’s access data to the website by third parties, given that they are personal and non-transferable.

15. MODIFICATION OF THE TERMS AND CONDITIONS

SILVIN reserves the right to amend these Terms and Conditions at any time and users will be deemed to have been notified by publishing the amended Terms and Conditions on the website https://silvin.pt.

16. TREATMENT OF PERSONAL DATA

Please read our Privacy Policy carefully so that you can become aware of the rules and procedures adopted by SILVIN with regard to the treatment of data collected when you browse the https://silvin.pt website and when you use the functionalities it offers, as well as the applicable security and confidentiality measures.

17. PROOF AND ARCHIVING

The computer records, kept by SILVIN under secure conditions, are considered proof of the communications, orders and payments made between SILVIN and the User.

18. APPLICABLE LAW

These Terms and Conditions and all disputes arising in connection with them, including their validity, the use of the website or any purchase therefrom shall be governed by Portuguese Law.
